Newton County case shows value of tax sale

A tax sale in Newton County that went to court proves how lucrative tax investing is

COVINGTON, GA

A delinquent property tax sale in Newton County, GA, saw a couple pick up 22 parcels of property for about $49,000. When they took possession of the property, they actually had $739,500 in property
Their buys included $10 for 3.74 acres and a house on a major highway with nearly an acre of land for $9,200. They also bought the taxes on a four other houses and wound up owning them
The court case tried to make the tax assessor use the tax sale as the baseline for determining the property value. They lost the case.
“They may have lost the court battle on assessments, but they got nearly three-quarters of a million dollars in property for the price of a fancy car or an RV. They paid less than seven percent of the fair market value for that property,” said Ted Thomas, an expert in property tax auctions and investing. “I don’t know of any other investment where you can turn $50,000 into $750,000 in a year’s time.”
The court case was not about the legality tax sales. The US Supreme Court has ruled in a number of cases on delinquent property tax auctions. Each time the High Court has said the sales are legal.
Delinquent property tax sales are part of the property tax collection in every state and some US territories. Every state has laws allowing these sales. While the exact timing and method of these sales vary from state to state, a constant in them is the ability to profit, Mr. Thomas said.
“I’m not just saying that. I’m living it. I make my living dealing in distressed real estate like property tax sales and I have made a good living doing it. If you only have $100 to invest, you can do this too,” he said.

Maryland county tax sale nets nearly $1 million

Harford County, MD, sells 459 properties for nearly $1 million; investors to reap large profits

MERRITT ISLAND, FL - Harford County, MD, just north of Baltimore, put 486 properties with past-due taxes on the auction block last week and took in nearly $1 million.

The auction saw 459 properties sold. Thirty-nine people registered for the online auction.
“That was 39 people who had the chance to invest in 486 properties. These people will earn 12 percent on the money they invested, a very good return in today’s economy. If the taxes are not redeemed, they can foreclose and own property in one of the Maryland’s fastest-growing communities,” said Ted Thomas, a noted expert in the field of property tax investing.”

Harford County is an affluent suburb of Baltimore and a coastal community as well. It’s prime real estate for people trying to move out of nearby big cities, but yet be close enough to enjoy city amenities, Mr. Thomas said.

Mr. Thomas said he expects more than 90 percent of the properties to be redeemed. That means the investors will earn that 12 percent on the money they spent. The other properties that won’t be redeemed will have new owners who got their real estate at a fraction of the fair market value.

“How much would you pay to have a home either on a bay or less than an hour’s drive from Chesapeake Bay?” he asked. “Now I want you to think about buying property like that for about 10 percent of the fair market value. Some people are going to own some excellent real estate which they can sell for far more profit than they could get just on the interest if the property was redeemed.”

The tax sale was advertised in local media and news stories also appeared online. Mr. Thomas said the 39 people who registered for the auction is pretty typical of property tax sales.

“People may know about property tax sales, but they don’t understand them. They don’t know that investors can make tidy profits and sometimes own very valuable real estate,” he said. “The fact is, this is a very safe way to invest money.”

A report in the Baltimore Sun states, “[The] winning bidders pay off county taxes and any penalties owed and then have a lien against the property until the owner either pays them back, plus redemption interest at a rate set by the county, or the lien holder forecloses and, subject to court approval, takes ownership of the property.”

New Tennessee law lets tax buyer take property sooner

Tennessee legislature approves law to let tax auction buyer take possession of property in less time

MEMPHIS, TN - People investing tax sales in Memphis, TN, are now able to take possession of property they buy at auction in as little as 30 days.

The change to the state law came at the request of Shelby County and Memphis officials as a way to fight urban blight in the Home of the Blues. The new law lets a tax buyer take “vacant and abandoned” property in as few as 30 days. The Volunteer State previously gave property owners a year to redeem the past due taxes and keep their property.

“This new law is going to a boon to Memphis to be sure,” said Ted Thomas, an international expert on property tax auctions. “City and County officials have been trying for years to get some properties cleaned up. Now they have another tool to that.”

People who invest in property tax sales are also going to win big on this one.

“Thirty days v. 365 days. A month v. 12 months, That is a major difference. People who buy these properties at a tax sale don’t have to wait a whole year any more. Thirty days and they can take the property,” Mr. Thomas said. “That means they turn a profit that much sooner. They can start renovating or list the property for sale in 1/12th the time it used to take.”

"With one-year right of redemption, you've got a neglected piece of property that sits another year with a leaky roof, another year with deteriorating paint, open windows, open to causal entry, many are burned. There's going to be a tremendous ripple effect,” said Trustee David Lenoir told the Commercial Appeal.

Mr. Thomas was equally quick to point out these properties are probably not the best Memphis has to offer. Abandoned properties can come with problems.

“If you intend to invest in these properties, do you homework. Get online and look at the properties with a street view program,” he said. “Pay attention to what you see.”

This does not mean the properties are a bad buy. Sometimes the buyer has to look at the land the house sits on. That could be worth much more than the house. A lot of companies will demolish a home just for the salvage rights, Mr. Thomas said.

“If the house isn’t worth saving, get someone to flatten it and haul it off. Now you’re left with an improved lot. You can sell it to a developer or build something there yourself,” he said

That’s one of the greatest thrills, introducing people to new bands. If they like goth sounds, Bauhaus, Sisters of Mercy, Alien Sex Fiend, then I like to point them to Black Metal as well like Bathory, Mayhen and Dark Throne,” he said. “Some like it, some don’t, but they have a new listening experience.”

Drop in distressed home sales across nation shows continued recovery from housing bust

MERRITT ISLAND, FL - A national report from CoreLogic released last week shows distressed property sales were 12 percent of the homes sold across the nation in March.
CoreLogic defines a distressed home as real estate-owned (REO; bank-owned) and short sales. A broader definition of distressed homes includes tax sales and homes in the foreclosure or bank possession process.

“When you break down the CoreLogic report, you see that bank-owned property was 8.4 percent of the total home sales and short sales were 3.7 percent,” said Ted Thomas, an international expert on distressed home sales. “That’s showing the banks are trying harder to unload the property they got as a result of failed short sales and foreclosures. This is good news for investors because banks do not like to own property. Owning property comes with a laundry list of maintenance issues banks are simply not equipped to handle.”

The CoreLogic report states, “Bank-owned properties typically sell at a larger discount than short sales.”

Mr. Thomas said real estate investors are finding great deals by talking with banks and making offers.

“It doesn’t cost you anything to walk into the bank office and speak with someone in the mortgage department. You get a list of available properties and then make an offer. You’re not out anything but a little time,” Mr. Thomas said. “If you have good credit and can prove the ability to make payments, you can often get a mortgage from that same bank.”

Michigan, Florida and Illinois are the monthly leaders in the report. Nevada, once a lead state in distressed property sales, continues to drop in the ranks. Of all the states, California has seen the greatest drop since the height of the housing bust, down 67.5 percent. Only North Dakota and the District of Columbia are within one percent of the housing bust peak figures.

“There is value to be realized in buying bank-owned property,” Mr. Thomas said. “You can live in it, rent it or put it on the market and sell it for a profit. When you buy direct from the bank, you aren’t paying commissions and you can sometimes avoid a lot of the closing fees.”

Tax sale in S. Georgia likely includes farms

July tax sale in rural Georgia’s Colquitt County will probably include some farm land

MERRITT ISLAND, FL - A coming property tax sale in rural Southwest Georgia is probably going to include some farm land.

“If you have ever wanted to own some acreage, maybe even a whole farm, here’s an opportunity for you,” said Ted Thomas, a national expert on property tax sales. “Colquitt County’s major industry is agriculture. It’s one of the larger counties in Georgia and is covered with farms.”

When the legal notice advertising began, some 300 accounts and 184 parcels were listed in the notices. Some of the taxes will be paid before the sale takes place on July 7. Mr. Thomas said that’s pretty common.

Exactly what properties are for sale can be read in the legals section of The Moultrie Observor or www.GeorgiaPublicNotice.com. The website has legal notices from each newspaper in the state, including the Colquitt County tax sale and sales from other counties and cities around the state.

“I highly recommend tax auction investors bookmark Public Notice and check it weekly for tax sales,” Mr. Thomas said. “You see the same notice at the website as appears in the newspaper. You can get an excellent idea of what the property is as well as where it is located.

In searching the notices, use “Cindy S. Harvin” as a keyword in the search box. Ms. Harvin is the Colquitt County Tax Commissioner and her name appears at the beginning of each the tax sale notices.

“The notices do not have the amount of taxes owed, but it does give you a case number and an address or a name. Before you call to see how much tax is owed, look up the property online. Get a satellite view first to see if it is within one of the cities or country and farm land. If it looks appealing, find a street view of the property,” Mr. Thomas said.

With that in hand, move to the next step. Call Ms. Harvin’s office with this information and find out how much tax is owed on the property. Her office can be reached at 229-616-7410.
Ms. Harvin’s office expects to get as much as $100,000 from the sale. “That right there tells you there will be more than $1 million worth of property in the auction,” Mr. Thomas said. “The past due taxes and associated fees are rarely more than 10 percent of the property’s value.”
